Margarito was in the U.S. illegally from Mexico and had already been deported. While leaving the place where he worked illegally, he jumped into a van which he didn’t have a license to drive, he fell asleep at the wheel, and drove head-on into another vehicle killing a 36 year-fire captain (Peter), and two of his children, Ellie (4), and Grayson (22 months old). He left behind a wife (Courtney), and four other children.
This is a terrible tragedy only to be compounded because Margarito was convicted but received only a two-year prison sentence. Can you imagine Courtney’s despair? She lost her husband and two children, and their murderer got only two years behind bars and that’s if he serves his entire sentence. I saw her interviewed and my heart was broken. How could this have happened?
The ultimate problem in this scenario was the sentencing guidelines; the judge’s hands were tied. It’s absolutely shocking that three involuntary manslaughter charges committed by an illegal immigrant, driving illegally, could end up with a two year sentence. On a more positive note this is Texas so law enforcement will notify ICE to get Margarito deported when he’s released from prison. If it were a sanctuary city like San Francisco, he’d get another opportunity to get behind the wheel and kill even more Americans.
My thoughts and prayers go out to all those who are negatively affected by this tragic loss of life. I’m sure they feel blessed to have had Peter, Ellie, and Grayson, in their lives even if it was for a short period of time.
